Flude Property Consultants Completes Successful Lease Assignment in South West London

Acting on behalf of Culligan, Flude Property Consultants have now concluded the lease assignment of their unit at 2c Endeavour Way, Wimbledon which became surplus to their business requirements.

With over 12 years remaining on the lease and almost 3 years until the break option, we marketed the unit and negotiated an assignment, which also released Culligan from any future liabilities. Our marketing generated a good deal of interest and multiple offers were received.

Will Thomas, Director said, “This was a more complex negotiation where we sought to secure our clients an assignment of their lease, but also agreed additional terms that removed Culligan from the authorised guarantee agreement (AGA), which is a clause often found in leases where ongoing liabilities can remain for the lease duration, should the new tenant default. This assignment has now made a significant saving to what were the future financial liabilities of the redundant unit.

Mike Beaumont from Culligan said, "In mid-2024, I was faced with a challenge of having to extricate my company from a property lease at a London site which was only 6 years into a 20-year lease and 4 years from the break clause. To add further complications, the site was owned by a Borough Council, which are generally renowned for their litigious and very slow processes due to governmental procedures. They were certainly not in any hurry to even talk about a settlement or assignment at that stage.

I had previously worked with Flude Surveyors (Matthew Le Seelleur) who had very efficiently and professionally handled a previous lease end with another leading property company. I made contact again and Matthew introduced me to Will Thomas who I met on site, and he very quickly educated me on the challenge ahead. This included marketing, and finding a new tenant, then encourage the landlord to take them on to continue the lease. It’s been a very long journey with Flude, the Borough Council and our legal teams over the last 18 months, but eventually Will’s tenacity and endeavours have contributed to a successful outcome, managing to get the assignment completed, remove some onerous lease clause and ultimately released my company from future liabilities and running costs.
